Terms of Use
These Terms of Use ("Terms") govern your use of Heartcaster, operated by Infinite Logic, PBC. ("we", "us"). By creating an account or otherwise using the service, you agree to be bound by these Terms.
1. The service
Heartcaster is a tool that helps you publish podcast episodes from Zoom cloud recordings. We connect to your Zoom and Buzzsprout accounts on your behalf, generate suggested titles and descriptions from your transcripts using AI, and provide a review surface for your designated reviewers to approve and publish each episode.
2. Account
You authenticate with a passkey via our authentication provider. You are responsible for keeping access to your passkey-protected device. Multiple users may share a single workspace ("heartcast"); owners may invite or remove other members at any time.
3. Your content
You retain all rights, ownership, and responsibility for the audio recordings, transcripts, episode metadata, and other content you upload, generate, or import into Heartcaster ("Your Content"). We claim no ownership of Your Content. You grant us a limited, non-exclusive, royalty-free license to store, transmit, process, and display Your Content solely for the purpose of operating the service for you.
You represent that Your Content does not violate the rights of any third party and complies with applicable law.
4. Acceptable use
You agree not to:
- Upload content that is unlawful, harassing, defamatory, or infringes intellectual property rights.
- Use the service to send unsolicited communications.
- Attempt to gain unauthorized access to any portion of the service, our infrastructure, or other accounts.
- Reverse engineer, decompile, or attempt to extract source code from the service.
- Use the service to compete with us or to build a substantially similar product.
5. Subscriptions and billing
Heartcaster is offered on a per-heartcast subscription basis. Each heartcast requires an active $5/month subscription before uploads, publishing, and Zoom auto-import are enabled. Subscriptions auto-renew until cancelled.
Payments are processed by Stripe, Inc. You may cancel at any time via the Customer Portal accessible from your settings page. Cancellation takes effect at the end of the current billing period; we do not provide partial refunds for unused time, except where required by law.
We may change pricing with at least 30 days' notice to active subscribers via email.
6. Third-party services
Heartcaster integrates with Zoom, Buzzsprout, AuthGravity, Stripe, and Cloudflare. Your use of those services is governed by their respective terms. We are not responsible for the availability, accuracy, or reliability of any third-party service.
7. Termination
You may terminate your use of Heartcaster at any time by cancelling your subscription and emailing support@heartcaster.com to request deletion of your account.
We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the security or integrity of the service.
8. Disclaimers
The service is provided as is and as available, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. AI-generated titles and descriptions are suggestions only; you are responsible for reviewing them before publishing.
9. Limitation of liability
To the maximum extent permitted by law, Infinite Logic, PBC. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the service. Our aggregate liability for any claim arising out of or relating to these Terms or the service is limited to the amounts paid by you to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold Infinite Logic, PBC. harmless from any claim or demand arising out of Your Content, your use of the service, or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
12. Changes
We may update these Terms from time to time. We will post the revised version here and update the "Last updated" date. Material changes will be communicated by email or in-app notice. Continued use after a change constitutes acceptance.
